Am I eligible for a gaming tax refund?
You are eligible for a
gaming tax refund if you: (1) are a US nonresident at the time of your
US gambling winnings & have eligible documentation to prove your US nonresident status, (2) have won money in the US within the last 3 years, (3) were issued an IRS form 1042-S by the US casino or gambling establishment that withheld your taxes, and (4) have gambling losses in the US to claim against your
US gambling winnings.
Are only Canadians eligible for a gaming tax refund?
The US has a foreign tax treaty with many other countries. Many international visitors to the United States are also eligible for an
American tax refund.
Does US Gambling Refund ™ only recover taxes from casino winnings?
Basically any gambling activity in the United States that requires a wager qualifies for a
USA tax refund if tax is deducted from the
US gambling winnings.
Taxable games in the United States include: bingo, raffles, contests, sweepstakes, greyhound racing, game shows, horse racing, jai alai, keno, lotteries, poker tournaments, and slots if you have surpassed a certain winning threshold.
Gambling winnings from table games (including baccarat, Big 6 wheel, blackjack, craps, and roulette) are not taxed, and thus a
USA tax refund cannot be claimed. However, gambling losses from these table games can be used to offset against your
taxable gambling winnings for a
USA tax refund.
How much time do I have to file for a USA tax refund?
You have up to 3 years to file for a
USA tax refund on your
gaming taxes.
Can I apply for a USA tax refund in the same year that I won money?
If you have won money in the United States in the current year, you cannot claim a
USA tax refund until the beginning of the next taxation year. However, you can still send us your details & information now and we will submit your application to the Internal Revenue Service as soon as it is eligible for a
USA tax refund.
What is the process in claiming back my gaming taxes?
After an initial consultation to determine your eligibility for a
USA tax refund, we mail you a gambling tax forms package to complete. After we receive the completed gambling tax forms package from you, we apply for an ITIN (federal tax id for a US nonresident) on your behalf. Once an ITIN is issued, we will complete a US non resident tax return to claim back your
gaming taxes. If the IRS approves your claim, you will receive an
IRS refund check for the withheld taxes.
What documentation do I need to reclaim my gaming taxes from the IRS?
You will need your 1042-S IRS form that the USA casino or gambling establishment has given you as well as acceptable forms of identification to prove your US nonresident status. Eligible forms of identification include an original or certified copy (by the issuing agency, the U.S. Embassy or a U.S. notary) of your current passport OR two other pieces of identification such as your current driver's license AND birth certificate OR citizenship card.
I lost the IRS form that the USA casino gave me when they withheld my gaming taxes; can I still claim a gaming tax refund?
We can obtain your I.R.S. form 1042-S on your behalf from the USA casino or gambling facility if you have misplaced or lost it. No fee is charged for obtaining a 1042-S IRS form replacement.
Do I need to submit my gambling loss records to the IRS when claiming a USA tax refund?
You do not need to submit your win loss records to US Gambling Refund ™ or to the IRS when filing your claim for a
USA tax refund. We do advise you to try your best to keep accurate records, in the form of maintaining a win loss diary and retaining your gambling receipts.
As part of your record keeping, in the year of your gambling winnings, you can also request a Win Loss Statement for Tax Purposes from each US casino that you played at after December 31.
If I choose US Gambling Refund ™ to recover my gaming taxes, do I have to pay an upfront fee?
We do not charge an upfront fee. We only send you an invoice for our tax services after the IRS has sent out your refund check. Our guarantee states that if the IRS does not issue you a
USA tax refund, we do not charge our fee. You have nothing to lose by choosing US!
Of the gaming taxes withheld, how much can I expect to get back from the IRS?
Depending upon the amount of gambling losses that you have to claim against your gambling winnings, we can file a claim for the full amount of tax withheld, or for a partial
USA tax refund. Our tax refund calculator can provide you with an estimate of your expected
USA tax refund from the IRS.
How long will it take to get my IRS refund check in the mail?
It takes between 12-16 weeks to receive your
IRS refund check in the mail from the time we receive your gambling tax forms package back in our office. If you can provide us with a previously issued ITIN (federal tax id for a US nonresident), then you can expect to receive your tax refund check within 6-8 weeks.
What currency is my Internal Revenue Service refund paid in?
Your
IRS refund check is paid in US dollars.
Can I reuse the ITIN (federal tax id for a US nonresident) you provide me for future US non resident tax return filing?
Yes. Please keep your ITIN in your files for future use, thereby speeding up the US tax recovery process the next time you have your
gaming taxes withheld by the IRS.
